DERPYCON ARTIST ALLEY APPLICATION WILL OPEN APRIL 15 2017 AT 8:00PM EST AND WILL CLOSE MAY 31 2017 AT 11:59PM EST. ALL APPLICATIONS WILL THEN BE PROCESSED UNDER A MODIFIED JURY.

DerpyCon is a multi-genre sci fi convention, celebrating the culture of science fiction, fantasy, animation, and beyond. DerpyCon will be having programming in sci-fi, gaming, anime, pop-culture, cosplay, and more. To learn more about DerpyCon, browse around our website at www.derpycon.com.

DerpyCon is entering its Fourth year, and the 2017 theme shall be “Medieval Wild West”. In 2016, we sold over 1,800 badges.

The show will be semi-juried. Mostly to make sure we don’t have like 10 plush artists and no print artists. Since it’s going to be a small show we want to make sure there is lots of diversity so that everyone can do well!

This document sets forth the regulations for the Artist Alley at DerpyCon 2017. By purchasing space in the DerpyCon 2017 Artist Alley you (the Artist) agree to abide by these regulations.

For $100 Artists receive a 6 foot table and 1 “Artist” badge, and may pay $35 for each additional “Artist” badge. Badges are to be worn at all times.

Payment will be arranged via Stripe via DerpyCon’s Payments Center website, or check or money order by mail.

Artists that have paid and cancel before August 31, 8:00 PM EST will receive a full refund. Artists that have paid and cancel before September 30, 8:00 PM EST will receive a 50% refund. There will be no refunds for cancellation after September 30, 8:00 PM EST.

Set-up begins at 7 am on Friday (November 17, 2017).

Age
You must be 18 or older to obtain a table at the con! (or have turned 18 before the date of the first day of the con)

Tax ID
Each artist alley member selling will need to register to collect sales tax in NJ. New Jersey law requires all vendors, even “one-time” vendors, to register with the State for tax purposes at least 15 business days before starting business, and to collect New Jersey sales tax on all sales of taxable tangible personal property or services. There are no special provisions for temporary vendors.
Once registered, you must file all required returns until you properly end your tax registration with New Jersey. File Form NJ-REG (Business Registration Application) to register with the State to collect/remit New Jersey taxes such as sales tax or employee withholdings, and to obtain a New Jersey tax identification number. You can register online or file a paper application. DerpyCon is not responsible for the vendor registration to New Jersey State for collecting sales tax.
DerpyCon has the right to remove a vendor if a Proof of Registration certificate is missing or not valid. To obtain a proof of registration, visit http://www.state.nj.us/treasury/revenue/proofreg.shtml

What you can sell?
Your artwork, as in it must be made by you! (or a member of your studio)
Fan art is ok but no copying or tracing will be allowed because you know plagiarism and copyright infringement are not cool.
If you can buy it in a store or the dealer’s room it shouldn’t be in the Artist Alley.
You cannot sell food or beverages.
Beyond that we should be pretty cool with everything. We will take it on a case by case basis if anything pops up!
If you are reported to be selling any of the above “not cool” things the Artist Alley Head and Con Chair hold the right to dismiss your table from the convention with NO REFUND.
Adult Material is ok but there shall be some guidelines as this will be a family friendly con (small children about) all adult material must be covered. If someone wishes to view your adult material please ID them before they view it. (They must be 18) not sure what is considered adult? pretty basic guideline is anything that wouldn’t be on television between the hours of 12 pm and 7pm ought to be covered!

Electricity
We have outlets in our room but the amount is limited. We will provide an extension cord. So if you request electricity we will try to place you near the outlet. (in your application please state what you will be using your power for as actual display will have priority over need to charge devices)

All artists are expected to check in with the head of Artist Alley.
You will need to have your confirmation email and a valid proof of identification.
You (and anyone with you) will be required to have a con badge as well as an Artist Alley badge while behind your table
We expect you to arrive in a timely fashion. If you have not arrived by 8pm on Friday of the con we will offer your table up for sale. (unless you contact the head of AA with your situation and we work it out with you)

These hours reflect an alley that will open an hour before dealer’s room, remain open throughout the day, and then close one hour after the dealer’s room closes. These times are subject to change.

Security and Overnight.

The room will be locked when the alley is not open. You will not be able to access your table until the determined set-up hours.

If the artist’s table is in the mall, they will have the following modifications to the agreement:

Payment is $50.00 for table and single badge.

There is limited security –we recommend you take all wares with you when you close up.

There are no set opening or closing hours –you may work as little or as long as you wish.

Food and Drink
No outside food or drinks are allowed in the artist alley.

Be respectful of your neighbors and other con goers
If you have any issues, complaints, or disputes please bring it to the attention of the staff! Alley staff will have final say in all solutions.
Please keep your things to your allotted space.

Enterprises, Inc. (hereafter “the Promoter”) and the Hyatt Regency Morristown (hereafter “theconvention space”, their respective officials, subsidiaries, agents, affiliates, operators, officers, volunteers and employees (hereafter ” the Indemnified Parties”) will not be liable for any injury, loss, or damage that may occur to the Artist or the Artist’s employees or property from any cause whatsoever. The Promoter will not be liable for failure to perform its obligations under this document as a result of strikes, riots, acts of God, or other causes of any kind whatsoever not within the control of the Promoter. Anyone visiting, viewing, or otherwise participating in the Artist’s exhibit is deemed to be the invitee or licensee of the Artist, rather than the invitee or licensee of the Promoter. The Promoter will not be liable for any injury whatsoever to the persons conducting or otherwise participating in the conduct of the Artist’s exhibit or to invitees, licensees or guests of the Artist. The Artist assumes full responsibility for the actions of its agents, employees, or independent contractors, whether acting within or without the scope of their authority and agrees to hold harmless the Indemnified Parties from responsibility or liability resulting directly or indirectly, or jointly, from other causes which arise because of the actions or omissions of its agents, employees, or independent contractors. The Artist understands that neither the Promoter nor the convention space maintains insurance covering the Artist’s property. It is the sole responsibility of the Artist to obtain such insurance. There is no other agreement or warranty between the Artist and the Promoter except as set forth in this document. The rights of the Promoter under this document is deemed waived except as specifically stated in writing and signed by an authorized officer of the Promoter. Any action, which the Promoter or the Artist may bring against each other, based upon or in any way related to this document or its performance, is brought forth in federal or state court located within the State of New Jersey, and the Promoter and the Artist hereby waive all questions of personal jurisdiction or venue in order to give effect of this provision. The Artist agrees to assume all risk, and to indemnify and hold harmless the Promoter and the Indemnified Parties from and against any and all claims, demands, defense costs, liability, expense or damages of any kind arising out of or in connection with the Promoter’s use of the leased premises or arising out of any act or omission of the Promoter or any of the Promoter’s employees, agents, contractors, representatives, patrons, guests or invitees; excepting such claims, demands, defense costs, liability, expense, or damages arising out of the sole negligence of one of the Indemnified Parties. The Artist assumes responsibility and agrees to defend the Indemnified Parties from and against any and all claims, demands, defense costs, liability, expense or damages of any kind arising out of or in connection with the Artist’s or the Promoter’s use of the leased premises. Neither the Promoter nor the Indemnified Parties will be responsible for any injury, loss, or damage that may occur to the Artist, the Artist’s employees, or property from any cause whatsoever. DerpyCon will provide unarmed security guard service for the exhibition space during the hours the exhibit premises are closed. However, Artists are solely and fully responsible for their exhibit material. All property of an Artist is understood to remain in the Artist’s care, custody and control in transit to or from or within the confines of the exhibit premises.

Artists understand that DerpyCon reserves the right to use the Artist’s name or image for promotional purposes. Artists also understand that DerpyCon reserves the right to release a vendor’s contact information to the public. Should any provision of this document be rendered or declared invalid by reason of any existing or subsequently enacted legislation or by any decree by a court of competent jurisdiction, such invalidation of such part or portion of this document will not invalidate the remaining portions, and they will remain in full force and effect.
